N.I.E. (número de identidad de extranjero) is an identification number for foreigners in Spain. N.I.E. is one of the first documents any foreigner in Spain would need to identify themselves for officials or to open a bank account, forming a company, etc.
Foreigners that have an economic, professional or social connection with Spain may apply for an N.I.E. (art. 206 Regulation of Organic Law 47/2000, approved by Royal Decree 557/2011, of April.) The N.I.E. could be applied for example assisted by a lawyer or personally at the Directorate-General of the Police (directly or through Spain's Consular Posts abroad).

by Ulrika Lomas, Tax-News.con, Brussels25 July 2019 The Government are planning to seek an approval of legislation to introduce a special tax for digital services in Spain.
"A DST was originally included in the Government's Budget Bill for 2019 in January this year. However, the bill was rejected by parliament, triggering elections in April 2019, which saw the incumbent Socialist Workers' Party gain the most parliamentary seats but fall well short of securing an absolute majority. Under Spain's earlier proposal, which is similar in scope to the recently approved French DST, a three percent levy would be imposed on companies with total revenues of EUR750m (USD841m) and with sales from digital services of at least EUR3m in Spain. It would cover revenues from the sale of online advertising, intermediary services, and the sale of user data" (https://www.tax-news.com/news/Spain_To_Press_Ahead_With_Digital_Tax____97210.html, citate from articlie by by Ulrika Lomas, Tax-News.con, Brussels25 July 2019) EU Takes Action Against Spain Over Rules On Reporting Overseas Assets (The famous modelo 720)8/11/2019 by Ulrika Lomas, Tax-News.com, Brussels13 June 2019 The European Commission is demanding Spain to the Court of Justice, because of the imposition of "disproportionate" sanctions for failure to report overseas assets.
The famous "modelo 720" requires resident taxpayers to declare assets they hold abroad. Failure to declare in time or committing an error in the declaration are subject to elevated sanctions, that are higher than those for similar infringements. Due to EU principles, model 720 is accused to be discriminatory and unreasonable. It is said that it does frame businesses and private persons from investing or moving across the borders in the EU single market. Earlier the Commission has started proceedings in this same against Spain in 2015 and 2017. The graph above shows statistics over the amount of enterprises in Spain in 2018, by number of employees.
The most common type of enterprises were "small companies" with no employees (appr. 1.8 million companies). Only 118 Spanish companies had over 5000 employees. The so-called Housing Credit Law aims to provide better protection for the buyer.
The new Spanish Mortgage Law came officially into effect on June 2019. In general, the differences in the new law are the following: - The costs of a mortgage are now shared more fairly. Banks may be obliged to pay for the tax, notary, land registry and gestoria fees. - Caps for charges to repaying the mortgage earlier. - Banks have to secure that the clients understand the details of the mortgage. - The borrower has to go to the notary at least to take a test 10 days before completion (usually done by lawyers with power-of-attorney). - Foreclose of homes is more difficult. New requirements state that lenders have to owe 12 months or 3% of the mortgage in the first half of the loan term (extended to 15 months or 7% of the debt in the second half). *The posts in this blog are only informative, they are not suitable for legal advice and they are not automatically be up to date. |
